Simon accepted the offer if a tenancy in chambers following the successful completion of his pupillage and his practice now covers civil & commercial (with a particular expertise in licensing work), property and family cases,
Simon’s practice covers a wide spectrum of money, family and property related work.
Over the last few years, Simon has appeared in the following notable cases: Martin-Sklan v White [2006] All E.R.(D) Nov) (High Court; bankrupt family’s interests outweighed creditors’ interests in forcing the sale of a home);
Ellis (Autospray) v King [2005] C.L.C. (Oct) (County court; the need for permission before issuing proceedings after discontinuing previous litigation ); Maguire v Hawkins (County Court; 5 day trial involving squatters claiming land); R v Barnet Y.C. ex parte Aszara Clarke-Marshall (Administrative Court; judicial review of decision to order retrial in failed criminal case); Roberts and Anr v The State [2003] All E.R. (D) 205 (Jan) (Privy Council; Caribbean jury inadequately directed by the trial judge but no record of summing up available.)
His general civil work takes in contractual disputes, debts, claims against banks, building and construction work, accidents, alcohol licensing, judicial review of council decisions, harassment, trespass to goods, sale of goods, and enforcing orders. Also he does some insolvency/bankruptcy litigation.
On the family side, Simon regularly undertakes work in complex ancillary relief cases, s.8 applications involving multiple experts, care work, FLA’96 applications and separating cohabitants cases.
On the property side, he is experienced in cases involving business tenancies, residential housing disputes, possessions actions, mortgage disputes, unlawful eviction, squatters, leasehold enfranchisement and anti-social behaviour injunctions.
Advocacy is an important aspect of Simon’s practice. He has lectured and delivered workshops on witness questioning techniques. Further, during the early part of his career, he gained invaluable advocacy experience presenting criminal cases to Magistrates and juries.
He is a member of the London Law Review’s Academic Editorial Advisory Board and is co-author or author of the following articles published in the Solicitors Journal: (a) How long to go (how borrowers stand in mortgage repossessions); (b) Caught Short (looking at banks bringing claims against mortgagors in mortgage shortfall cases); (c) Boys will be boys (liability in some personal injury claims) (d) Airlines check in (guide to compensation for cancelled, delayed or overbooked aeroplane flights); (e) Wish you weren’t here (quantifying compensation for victims of substandard holidays)
On a lighter note, Simon has judged international mooting competitions held in the Royal Courts of Justice.
