Community Order Secured for Vulnerable Young Defendant in Serious Knife Offences Case

Tinessa Kaur, instructed by Haroon Saber of Arcadian Law, successfully represented an exceptionally vulnerable young defendant at sentence before Snaresbrook Crown Court in relation to 8 offences, 7 of which involved the publishing, marketing and sale of knives, including combat knives, a "Rambo" knife and the "Godsword".

The case carried significant sentencing risk. Several of the offences carried a maximum sentence of 4 years' imprisonment, and due to the chronology of the offending there was a real prospect that any custodial sentences imposed could have been ordered to run consecutively.

By the date of sentence, the client had already served approximately 20 months collectively on remand and whilst subject to electronic monitoring.

Tinessa's preparation for sentence was thorough, meticulous and strategic. Comprehensive psychological and psychiatric expert evidence was obtained, alongside extensive supporting material from the client's professionals. A detailed sentencing note was prepared, bringing together the expert evidence, the relevant sentencing principles and the significant personal mitigation arising in the case.

The Court heard evidence of the client's exceptionally difficult upbringing. He had been care experienced from an early age and had endured significant childhood trauma and instability. Expert evidence established that he presented with Autism Spectrum Disorder, ADHD, severe PTSD, severe anxiety and depression, together with significant neurodevelopmental vulnerabilities. Those factors materially affected his judgement, emotional regulation, susceptibility to influence and overall culpability.

In her written submissions, Tinessa also highlighted the client's extremely difficult experiences whilst in custody, including repeated intimidation, threats and violence from rival prisoners. The expert evidence demonstrated that his psychological vulnerabilities placed him at particular risk within the custodial environment and strongly supported a rehabilitative rather than punitive approach.

During sentencing, the Judge observed that the client had already served the punitive element of his sentence, commenting that had he not already spent such a considerable period on remand and electronic monitoring, an immediate custodial sentence would have been imposed. The Court accepted, however, that the appropriate focus was now rehabilitation, a conclusion that was also supported by the Pre-Sentence Report prepared by the Probation Service.

The Judge also commended the thoroughness of Tinessa's written sentencing note, recognising the comprehensive mitigation advanced on the client's behalf and the importance of the expert evidence obtained in assisting the Court's sentencing exercise.

Having considered all of the evidence, the Court imposed a two-year Community Order, rather than an immediate custodial sentence or a suspended sentence, providing the client with an opportunity to continue his rehabilitation within the community.

This successful outcome was achieved through the collaborative efforts of Tinessa Kaur, Haroon Saber of Arcadian Law, and the client's dedicated Social Worker, whose combined work ensured that the Court had a complete picture of the client's vulnerabilities, rehabilitation, care history and future support. Together, that collaborative approach enabled the Court to reach a just and proportionate sentence, giving a highly vulnerable young man a genuine second opportunity to rebuild his life within the community.
