Carl Buckley instructed by Instalaw Solicitors on behalf of the family of Jaiden Shehata, a young man of 11 years tragically killed on a level-crossing whilst walking to school.
Following a two week inquest, the jury found accidental death, and causative factors to include the fact that Jaiden had been distracted by his mobile phone, but importantly, that the level crossing itself was causative in that Bourneview was a passive crossing, which was not fitted with active warning systems giving a visual and auditory warning of the train's approach.
