Inheritance Act Advices

Our barristers can advise you on the merits of an Inheritance Act claim (under the The Inheritance (Provision for Family and Dependants) Act 1975), and can advise, assist and represent you during an Inheritance Act claim. Our barristers can also provide you with written advice when a person dies and you are a beneficiary of the estate, but someone else makes a claim under the Act. Here, we consider the fees (and likely timescales) in relation to you instructing one of our barristers to provide you with a written advice on the merits of making or defending an Inheritance Act claim.

Fees

We typically charge fixed fees, which means that we will charge you a set amount of money for the work. These are based on an hourly rate multiplied by our estimate of how many hours the barrister will be engaged on the piece of work.

We provide below some estimated fees for different types of work. These are estimates, given as a range. 

The reason for the range is that various factors will affect the actual quotation given, including: (1) the experience/seniority of the barrister to be instructed; and (2) the complex of the work; (3) the amount of work required.

All fees exclude VAT (where applicable).

If you have a particularly complex case, or particularly large amount of work will be require, the fees quoted may be higher than the estimates below.

The above is based on an hourly rate of between £200 + VAT – £450 + VAT per hour, with an estimated time taken, being approximately 10 – 15 hours.

Timescales

Timescales for your written advice may vary depending on factors such as your barrister’s availability, the value and complexity of the deceased person’s estate, your financial needs and those of the beneficiary of the estate. However, claims under the Inheritance Act must be made within six months of the grant of probate, so, to give you a guide, your written advice should be available within, about two to four weeks, where possible.
