Acquittals across 7-count indictment

Eorann O’Connor represented a defendant acquitted by the jury of 7 offences.

Police officers sought to detain the defendant, during which a police dog was deployed and bit the defendant’s arm causing multiple lacerations. The prosecution relied upon body-worn video footage; it was alleged that the defendant assaulted an officer and attempted to cause unnecessary suffering to the police dog (Counts 4-5). 

In a separate incident said to have occurred the same day although not reported at the time, the prosecution alleged that the defendant strangled a woman in a park, repeatedly punched and sexually assaulted her (Counts 1-3). Counts 6 and 7 concerned stalking and racially aggravated harassment alleged to have been committed against the same complainant. The prosecution case included evidence from five witnesses, photographs, hospital notes and dental records to demonstrate injuries including loose teeth.

The jury acquitted the defendant of all counts: counts 1, 3, 4, 5, 6 and 7 unanimously; count 2 by majority.
