Elizabeth is regularly instructed in a variety of Property and Commercial Disputes. Elizabeth provides a range of legal services to landlords, tenants, local authorities, housing associations, and charities.  Property and Housing 

Elizabeth has experience across the range of property issues from real property to landlord and tenant litigation. Elizabeth is often instructed to deal with issues involving leasehold matters, boundary disputes, and trusts of land. Elizabeth regularly provides advocacy in multi-day hearings, as well as, drafting advices, notices, pleadings and pre-action letters.  Elizabeth's experience in property and housing includes: 

  • Possession proceedings, including possession claims by mortgagees, LPA Receivers, Landlords and charge holders. 
  • Stays of warrants and writs. 
  • Adverse possession,
  • Forfeiture
  • Service charge and leasehold disputes, including breaches of leases.
  • Rent repayment orders. 
  • HMO Licensing. 
  • Boundary Disputes.
  • Drafting and making representations in respect of planning appeals.  
  • TOLATA disputes.

  • Enforcement of easements and covenants relating to land.

  • Injunctions, including anti-social behaviour injunctions and committals. 
  • Environmental Protection Act proceedings, both prosecution and defence.

Recent Cases

  • Successfully obtaining damages against a Local Authority in respect of disrepair in a Property following trial. 
  • Representation in a boundary dispute where damages were also sought pursuant to alleged breaches of the Party Wall Act Agreement. 
  • Advising a Leaseholder in respect of overpayments of service charge. 
  • Advising and acting for a tenant who had been unlawfully evicted. 
  • Drafted grounds of appeal for a s.205 Housing Act 1996 appeal, which resulted in the Local Authority resiling from their position.
  • Advising and representation in a multi-day proprietary estoppel claim. 

 Commercial and Insolvency 

 Elizabeth has vast experience in commercial matters, in particular Contractual Disputes and Insolvency. 

Elizabeth regularly appears in the County Court and the Insolvency and Companies Court and has experience with regard to a wide range of insolvency matters, including: 

  • Winding-up petitions and bankruptcy petitions 
  • Applications for validation orders 
  • Applications for Orders for Sale 
  • Applications to annul bankruptcy orders

 Elizabeth's commercial work includes drafting of and interpretation of contracts, breach of contract and related claims, claims regarding the supply and sale of goods and services.  As well as appearing in trials, applications and costs and case management conferences, she has drafted pleadings in claims for breach of trust, negligence, and breach of contract, and is happy to advise at all stages of litigation.

 Elizabeth has particular experience in advising and representing Claimants in mis-selling claims brought under section 75 and/or 140A of the Consumer Credit Act 1974.

In her spare time, Elizabeth enjoys baking, attending the theatre and attempted to knit and crochet. Elizabeth is a dog lover and enjoys spending time with her Cockapoo, Nelly.
