Another Injunction Success

Philip Williams and Elizabeth Fisher have successfully opposed an application for an interim injunction in the High Court. Phil and Elizabeth were instructed by Sanders Witherspoon LLP at short notice to oppose an application for what purported to be a freezing injunction, however, in reality was a proprietary injunction. The Application was made by an alleged “Trustee” who was not a party to the underlying claim.

The underlying claim relies on a suspicious “Trust Deed” which purports to undermine a will which Philip and Elizabeth’s clients rely on to distribute the assets of their late Father’s Estate. In opposing the Application, Philip and Elizabeth identified no less than 8 material inconsistencies within the Application and the underlying proceedings.

The Application was dismissed with costs, as it was procedurally hopeless.
